Software Licence Compliance

Overview

Our compliance policy

At Sogelink, software licence compliance is an essential commitment. The aim is to protect our intellectual property, but above all to guarantee our users reliable, secure solutions that comply with the regulatory requirements of their projects.

Sogelink’s compliance approach aims to prevent and remedy fraudulent use and to raise awareness of the risks associated with software piracy. It is also intended to make it easier to identify and report non-compliant situations, whether this involves fraudulent use or an unauthorised reseller.

Our compliance policy

Sogelink’s compliance approach is based on three strong commitments the group makes to responsible governance:

  • protecting intellectual property, to preserve the innovation and quality of our software,
  • an ethical commitment, built on trust, transparency and accountability,
  • supporting users, to prevent non-compliant situations and make it easier to remedy them where necessary.
Method

Understanding fraudulent software use

What is software piracy?

Software piracy refers to any use of software outside the conditions set out in its associated licence. This can include:

    • using the software with a pirated licence,
    • an employee “freely” downloading software from an illegal platform,
    • sharing a named licence with other users,
    • acquiring software through unofficial sources or resellers.

Some situations may result from a lack of information or changing usage patterns. Others amount to clear-cut fraud. The compliance approach aims to distinguish between these cases and respond to them appropriately.

Risks

The risks for your business

  1. Security risks

Pirated software may contain malware, cybersecurity vulnerabilities or spyware that expose your data and systems.

  2. Operational risks

Without a licence, there is no official update, no technical support, and no guarantee of compatibility with regulatory or technological developments.

  3. Legal risks

Fraudulent use exposes the company to civil and criminal liability. As such, the company's management is responsible for the equipment provided and for the actions of its employees.

  4. Financial risks

Fines, forced remediation, business interruption or indirect costs can all affect the organisation.

Regulations

In France, software piracy constitutes an infringement of intellectual property rights. It is governed by the French Intellectual Property Code, which provides for civil and criminal penalties of up to 3 years’ imprisonment and €300,000 in damages for counterfeiting or fraudulent use. Complying with software licences is therefore not simply good practice: it is a legal obligation for any company or public body.

This is why Sogelink deploys contractual and technical measures designed to ensure compliant use of its solutions, including:

  • defined contractual terms: our software is offered under licence models specifying the number of users and their details (for named licences), as well as the authorised functional scope.
  • controlled verification mechanisms: licence ID authentication/validation systems, access monitoring and end-of-contract management help prevent non-compliant use.
Obligations

Your obligations as a user

Compliant use of our software relies on simple, everyday rules:

  • purchase only authentic licences from Sogelink or authorised resellers,
  • do not share an account or named licence between several people,
  • stay within the contractual scope,
  • contact Sogelink if in doubt or if usage changes (new site, subcontracting, reorganisation).

To check your compliance, a few simple actions can be put in place:

  • take stock of the installations and workstations concerned,
  • carry out an annual review of your active licences,
  • reconcile purchased licences with active users.
Our team

The Sogelink team in charge of compliance

You can also contact our compliance team and/or your Customer Success contact for a voluntary audit, as part of a preventive, supportive approach.

The dedicated compliance team’s mission is to:

  • monitor how Sogelink software is used,
  • support users in meeting their obligations,
  • analyse reports and at-risk situations,
  • protect the interests of all stakeholders.

As part of a verification, it may need to request:

  • proof of purchase for one or more licences,
  • the list of associated users or workstations,
  • temporary access to a specific workstation, only with the explicit agreement of the contact person and in their presence,
  • an audit of the company’s IT system.

Each situation is handled through a simple verification process:

  1. Receipt of the report or identification of a situation to verify
  2. Preliminary analysis
  3. Internal verification of the available information
  4. Contact with the entity concerned if necessary
  5. Closure of the case following remediation, where applicable
