At Sogelink, software license compliance is an essential commitment. The objective is to protect our intellectual property, but above all to guarantee our users reliable, secure solutions that comply with the regulatory requirements of their projects.

The compliance approach implemented by Sogelink aims to prevent and regularize fraudulent uses and to raise awareness of the risks associated with software piracy. It is also part of a desire to facilitate the identification and reporting of non-compliant situations, whether it is fraudulent use or an unauthorized reseller.

Our Compliance Policy

Sogelink’s compliance approach is based on three of the group’s strong commitments in terms of responsible governance:

  • the protection of intellectual property, to preserve the innovation and quality of our software,
  • an ethical commitment, based on trust, transparency and accountability,
  • support for users, in order to prevent situations of non-compliance and to facilitate their regularization if necessary.

Understanding the fraudulent use of software

What is Software Piracy

Software piracy refers to any use of software outside the terms of the associated license:

  • Use of the software with a pirated license,
  • The “free” downloading of software by an employee on an illegal platform,
  • Sharing an assigned license with other users,
  • Acquiring software through unofficial sources or resellers.

 

Some situations may result from a lack of information or a change in usage. Others are the result of obvious fraud. The compliance approach aims to distinguish these cases and respond appropriately.

Risks to your business

Security risks: Pirated software may contain malware, cybersecurity vulnerabilities, or spyware that exposes data and systems.  

Operational risks: Without a license, there is no official update, no technical support, and no guarantee of compatibility with regulatory or technological changes.

Legal risks: fraudulent use engages the civil and criminal liability of the company. As such, the manager is responsible for the equipment provided and the actions of his employees.

Financial risks: fines, forced regularizations, business interruption or indirect costs can impact the organization.

In France, software piracy is an infringement of intellectual property rights. It is governed by the Intellectual Property Code, which provides for civil and criminal sanctions, which can go up to 3 years in prison and €300,000 in damages, in the event of counterfeiting or fraudulent use. Compliance with software licenses is therefore not just a good practice: it is a legal obligation for any company or community.

This is why Sogelink deploys contractual and technical measures to guarantee the compliant use of its solutions with:

  • Defined contractual conditions: our software are offered according to license models specifying the volume of users and their contact details (for assigned licenses) as well as the authorized functional scope ;
  • Supervised control mechanisms: authentication/validation of a license ID, access monitoring and end-of-contract management help prevent non-compliant use.

Your obligations as a user

The proper use of our software is based on simple rules that can be applied on a daily basis:

  • purchase only genuine licenses from Sogelink or authorized resellers,
  • not share an account or a dedicated license between several people,
  • respect the contractual perimeter,
  • contact Sogelink in case of doubt or changes in uses (new site, subcontracting, reorganization).

To check your compliance, a few simple actions can be put in place:

  • Inventory the installations and substations concerned.
  • Conduct an annual review of your active licenses.
  • Reconcile purchased licenses with active users.

It is also possible to contact our compliance team and/or your Customer Success referent for a voluntary audit, in a logic of prevention and support.

 

Sogelink team in charge of compliance

The compliance team is responsible for:

  • monitoring the use of Sogelink software,
  • supporting users in their obligations,
  • analysing reports and risk situations,
  • protecting the interests of all stakeholders.

As part of an audit, it may be required to request:

  • proof of purchase of one or more licenses,
  • the list of associated users or positions,
  • temporary access to a specific position, only with the explicit agreement of the interlocutor and in his presence,
  • an audit of the company’s IT system.

Each situation is handled through a simple verification process:

  4. 4. Contact with the relevant entity if necessary
  5. 5. Closure of the case following regularization if necessary

How do I know if my software is genuine?

Genuine software is acquired from Sogelink or an authorized reseller and has a valid license.

What should I do if I am unsure about my use?

In case of doubt, it is recommended to contact your Sogelink sales representative or the Compliance team to verify the situation.

How do I make sure that my reseller is an official Sogelink reseller?

Is the report anonymous?

A report can be made without your identity being made public. The information transmitted is treated confidentially.

What happens after a report?

Each report is analysed and processed by our teams. By leaving your contact details, a progress report will be sent to you to keep you informed of the progress of the file.

What to do if the contract ends?

The use of the software must cease at the end of the contract, unless renewed or specifically agreed with Sogelink.

Report fraudulent use or unauthorized reseller

Your report helps protect the Sogelink ecosystem and all its users. Any third party with relevant information can make a report. The data transmitted is treated confidentially and only as part of the compliance process.
